When the Just & Fair receives your Request for Mediation application, Dispute Resolution staff will contact the other parties and seek their agreement to mediate. You will receive copies of our communications to the other parties.

Referral to the Just & Fair mediation is consensual. A Just & Fair mediation can only take place if both parties have agreed to such procedure by means of a Just & Fair mediation clause in the relevant contract, or by means of a Just & Fair mediation submission agreement.

In the absence of a mediation agreement between the parties, a party that wishes to propose submitting a dispute to mediation may submit a unilateral Request for the Just & Fair Mediation in writing to the Just & Fair Mediation Centre and to the other party. The Just & Fair Mediation Centre may assist the parties in considering the Request for Mediation.

A Just & Fair mediation is commenced by a party submitting a Request for Mediation in writing to the Just & Fair Mediation Centre.

If a mediation agreement between the parties exists

The Request for Mediation should contain:

  • A request that the dispute be referred to mediation under the Just & Fair Mediation Rules
  • The names and full communication details of the parties and their representatives
  • A copy of the mediation agreement
  • a brief statement of the nature of the dispute
  • any observations relating to the appointment of the Mediator, including the mediator’s expected qualifications (optional)

If there is no mediation agreement between the parties

The Unilateral Request for Mediation should contain:

  • A request that the dispute be referred to mediation under the Just & Fair Mediation Rules
  • The names and full communication details of the parties and their representatives
  • A brief statement of the nature of the dispute
  • Any observations relating to the appointment of the Mediator, including the Mediator’s expected qualifications (optional)

The Just & Fair Mediation Centre recommends that, where appropriate, the Request for Mediation is submitted by e-mail. Alternatively, the Request for Mediation may be submitted online using the Just & Fair Web Portal forms. Upon submission, a copy of the Request for Mediation will be sent to the other party.

Inform the parties

Upon receipt of the Request for Mediation, the Just & Fair Mediation Centre shall inform the parties in writing of the receipt by it of such Request and of the date of commencement of the mediation.

Costs of Mediation

Please note that costs of mediation, including the administration fee and the fees and expenses of the mediator, shall be borne in equal shares by the parties, unless they have agreed otherwise.

We will be pleased to give you a quotation for your chosen mediator after we have had the opportunity of discussing the details of the potential mediation with you. The fees quoted to you will be the total fees you will be asked to pay for the mediator’s services. There are no additional booking or administration fees.
